Auction Buyer Terms 

Terms and Conditions of Sale:


All bidders who wish to bid in the auction must register with the Auctioneer and obtain a bidder number. Bidders must be at least eighteen (18) years of age and furnish a driver's license or other valid identification. 

The Auctioneer reserves the right to refuse to register or admit a bidder at the Auctioneer's sole discretion. 

The high bidder agrees to purchase the lot for the price of the lot item high bid, plus the 10% buyer's premium to equal the final contract price.

The purchaser agrees that no stop payment of funds will be made, and checks returned for insufficient funds constitute fraud. Any fines, penalties or added expenses resulting from such actions will be sole responsibility of the buyer that caused such actions and will be payable in full by that buyer. 

All bidder fees are non-refundable and non-transferable. 

The purchaser agrees to take ownership of the lot upon the fall of the gavel and willingly assumes all responsibility and liability for the merchandise without exception. 

All transactions are subject to the laws of the state in which the auction takes place. The highest bidder will be the buyer of the item. 

If there is a disputed bid the bidding will be re- opened at the discretion of the auctioneer, the auctioneers decision is final. 

All lots are sold in "as is, where is" condition without any warranties or guarantees. 

The purchaser must inspect, examine and form a personal opinion for the purchase. Anything written or implied as to authenticity, originality or condition of any lot are not the guarantee of Caprock Auction Group and should be determined by the purchaser's own inspection and discretion. The vehicle and information presented at the time of auction is final and supersedes any previous representations. The information provided is deemed reliable from the seller but is not guaranteed by Caprock Auction Group. 

Caprock Auctions is not responsible for stolen, damaged or lost properties. 

Any litigation will be between the buyer seller. Caprock Auction Group is only providing an auction service and does not own or represent any property as its own. 

No photographs, audio recordings or video recordings are permitted at the auction without the express permission of the Auctioneer. However, the Auctioneer may make photographic, audio and/or video records of the auction for future promotional or advertising purposes. The use of such photographs, audio and/or video records with the bidder's likeness or image is hereby authorized by all bidders. 

Onsite Buyers are subject to a buyer's 10 percent premium at end hammer price. 

Online Buyers are subject to a buyer's 13 percent premium at end hammer price. 

All Titles will be processed in 21 working days dependent on confirmation of payment in full.

All purchases must be paid for within 1 hour (if bidding on multiple items please make prior arrangements to pay for items together.) 

The high bidder, as recorded by the Auctioneer, agrees that the high bid is an irrevocable offer to pay the Final Purchase Price for the Property. 

It is the responsibility of every bidder to make certain that his or her bids are made known to the auctioneer. The Auctioneer disclaims any responsibility or liability arising in any way from bids not spotted, executed or accepted. In the case of any dispute between bidders, the Auctioneer reserves the right, in the sole discretion of the Auctioneer, to reopen the bidding pursuant to terms determined by the Auctioneer in the Auctioneer's sole discretion. The Auctioneer, at the Auctioneer's sole discretion, may reject, disqualify or refuse any bid which Auctioneer believes to be fraudulent, illegitimate, offered in bad faith, or offered by someone not qualified to bid. The auction sale is complete when the Auctioneer so announces. Should a dispute arise between bidders after the completion of the auction, the Auctioneer's records shall be deemed conclusive in all respects.Auctioneer will not be bidding on behalf of any sellers. The auction will be between the onsite bidders, online bidders and absentee bidders that have made a pre auction escrow deposit and an absentee bid. 

The purchase does not constitute a warranty or an agreement between Caprock Auction Group and the buyer as Caprock Auctions is performing only the auctioning service and is not the owner of the lot and makes no guarantees of the condition of vehicle, title condition, or any other representations. 

All vehicles must be removed by Monday, August 15 at 5 p.m. It is the responsibility of the buyer to arrange for removal of the vehicle, shipping, and all associated costs. 

Cash, Check with Bank Letter, and Credit Card will be the only accepted methods of payments at the auction.

Bidder Fee Agreement

 If your bid is accepted as the winning price on any vehicle, a buyer's fee will be charged in addition to the accepted bid price. The buyer's fee is charged by the auctioning dealer for conducting the sale. The buyer's fee that will be added to your accepted bid price is 10 percent for any vehicle purchase or 12 percent if the vehicle is purchased by absentee bid.


Vehicle Removal Agreement

The bidder acknowledges that the auction event grounds must be cleared no later than 24 hours after the auction. If the bidder purchases any vehicle(s) they must be removed by this date and time. If they are not removed by a purchaser prior to this time, the vehicles will be removed and the purchaser will be billed for any and all towing, storage and labor charges related to clearing the vehicle from the premises. The bidder acknowledges the duty to clear any purchased vehicle(s) from the auction event grounds, and authorizes Caprock Auctions to bill him or her for any and all towing, storage and labor charges related to clearing any purchased vehicle from the premises.

Banker Letter

Bidders must mail a bank letter of guarantee. The vehicle must be paid for using a check or wire transfer from this account only. The letter should be printed on bank letterhead or come from an official email from the bank official and follow this exact format.

This letter shall serve as your notification that [BANK NAME] will honor/guarantee payment of any check(s) written by [BIDDER'S NAME], up to the amount of [U.S. DOLLAR AMOUNT], drawn on account [ACCOUNT NUMBER], or that [BANK NAME] will honor/guarantee transfer of U.S. funds, as instructed by [BIDDER'S NAME] up to the amount of [U.S. DOLLAR AMOUNT] the next banking day following the purchase(s). This guarantee of check(s) applies only to the Caprock Auctions Group for all purchases made on August 13, 2011. No stop payment will be issued. If further information is needed, please contact this office.
